SAN JOSE, California – Hours later Judge Edward Davila the jury ordered During the Elizabeth Holmes criminal trial for further deliberation, they remained deadlocked on 3 of the 11 criminal fraud charges faced by the Theranos founder.
Davila was notified of the grand jury’s second note at about 2:40 p.m. PT on Monday, about three hours after he presented jurors with the so-called Allen charges, a leading them to try harder to come to a unanimous agreement.
With jurors yet to reach a consensus on those three counts, Davila sent them back to rule on eight other counts, if they were ready.
The debates lasted more than 50 hours over seven days. The jury was bring the case on December 17, after a three-month trial involving 32 witnesses, most of which were called by the prosecution. Holmes, 37, was the main witness in her defense.
Holmes returned to the San Jose, California courthouse for the second time on Monday, along with her parents and her partner, Billy Evans. Some of Holmes’ friends were also present.
Her initial appearance the morning marked Holmes’ first visit to the courtroom since December 23, when the jury last pointed out that it contained a note for Davila. Holmes was staying at a hotel across the street and now only appears in the courtroom when notified to the judge.
This is the third and fourth time that jurors have issued a note to Davila. The first is on December 21, when they asked if they could bring the guide home to review. Davila denied the request and said that all discussions must take place on the spot. Two days later, they asked to listen to audio they had previously heard during Holmes’ trial and her conversations with several investors in the failed blood test company.
Earlier on Monday, Davila read the 2nd jury instructions to jurors. The guide reminds them that Holmes is innocent until proven guilty and that the burden of proof rests with the government.
The judges were last convened on Wednesday, and after failing to deliver a verdict, they took the rest of the week off for a New Year’s break.
Holmes, who was charged with nine counts of telephone fraud and two counts of conspiracy to commit wire fraud, will face up to 20 years in prison if convicted. She pleaded not guilty.
