Trump asks for wrongful trial in E. Jean Carroll rape libel trial

Former President Donald Trump on Monday requested a false trial in writer E. Jean Carroll’s rape and civil libel case, accusing the judge of making “unfair and prejudicial judgments” against him.

The claim came after Carroll said Trump “rape me” and “damaged my reputation” for two days testimony in the trial, begin last week. Carroll is expected to return to stand before federal court in Manhattan on Monday.

In one 18 pages long letterTrump’s attorney, Joe Tacopina, argued that Judge Lewis Kaplan misrepresented the evidence in favor of Carroll, bolstered her testimony and raised false objections from Carroll’s attorneys, which interfered with the questioning of his witness.

Tacopina asked that if Kaplan did not allow a mistrial, he would “correct the record for each and every case where the Court misrepresented the facts of this case to the jury” and to the attorneys. Trump’s “greater powers” during cross-examination.

Carroll alleges Trump raped her in the locker room of a New York City department store in the 1990s, and then defamed her as she told the story decades later. Tacopina’s letter argued that Kaplan had “closed” an “appropriate line of questioning” about whether Carroll sought to retrieve surveillance footage from the department store. The letter also said that the judge’s interference with Tacopina’s use of the phrase “criminal charges” resulted in “unfairness” against Trump.

Tacopina also points to a moment in his cross-examination of Carroll when Kaplan notes that Carroll’s book, titled “What Do We Need Men For? A Modest Proposal,” mentioned refers to a famous satire when it called for all men to be moved to Montana.

“It comes from ‘A Modest Proposal’ by Jonathan Swift,” Kaplan noted in court. That comment showed “jury bias,” Tacopina’s letter argued.

Trump, the leading candidate for the 2024 Republican presidential nomination, has not made it clear whether he will join any part of the test.

Carroll’s attorney did not immediately respond to CNBC’s request for comment on the letter.
