Huge loophole with Queensland’s mobile phone laws closed


It doesn’t matter if your mobile phone doesn’t have a SIM card inside – you’re still not allowed to use it behind the wheel, says the Queensland government.

“Specifically, it is illegal to use a mobile phone even if the phone function cannot be used or if it is being used for a function other than the telephone function,” said Transport Minister. and Mark Bailey Roads said, as reported by 7News.

“For example, it is illegal to use a mobile phone without a SIM card to play music or as a camera while driving.

“These behaviors are just as distracting and dangerous as using phone functions.

“Recent amendments aim to clarify mobile phone usage rules for drivers and ensure all mobile phone use while driving is illegal.”

An amendment to the Queensland Roads Act this month closed a loophole that would allow motorists to get away with a fine – $1078 and four demerits – if your mobile phone function is unusable, i.e. because the SIM card has been removed or it is in airplane mode.

The wording also specifically prohibits you from using the mobile phone “for a function other than the telephone function”.

You are not allowed to hold a mobile phone in your hand or on your lap while your vehicle is in motion or stationary but not parked.

Mr. Bailey said the amendment did not expand the range of regulated devices.

Queensland has launched the move mobile phone detection camera it can also determine if the occupants are wearing seat belts.

The camera uses AI technology to scan images for a mobile phone or is missing or improperly fastened – yes, you can be fined if your seat belt is fastened but the belt is under the wing your hand for example.

If AI technology detects a violation, the image will be flagged and a member of the Department of Transport and Roads (TMR) team will review the image to make sure the violation has been committed.

If there is any doubt, a notice of violation will not be given. But if a notice is issued and the driver feels they have been incorrectly fined, they can view high-resolution images through the TMR portal.
