An Ipoh cyclist has won a lawsuit against Sungai Siput, Perak, the town council and the Perak County and Land Office, for negligence in road construction and maintenance. Plaintiff Ernest Balasingam, an Labor Relations lawyer, in a lawsuit filed with Sungai Siput Magistrates Court, sued for damages and injuries sustained by him while cycling through a speed bump. unmarked on the road.
In his lawsuit, Ernest filed a lawsuit against the Sungai Siput Town Council, the Perak District and Land Office, the Department of Public Works, the Perak State government as well as the Federal government. Ernest was injured while cycling downhill and encountered an unclear speed bump near Kampung Kening Middle School on Kampung Pisang to Jalong Tinggi Road, causing him to crash.
Ernest’s initial lawsuit singled out the Federal and State governments as well as the local council as all parties refused to accept responsibility. Upon investigation, it was determined that jurisdiction over the road belonged to the state government and the local council with the complaint against the Federal government therefore withdrawn.
In place in the suit, the speed bump is built by an unknown side. In the initial issue of the Notice of Claim, neither party responded to the claimant’s liability, resulting in all parties being mentioned.
Talking to paultan.org Ernest said unmaintained roads were a violation of the government’s statutory obligations. “There is a legal requirement that they (the authorities) be held liable if they violate their statutory obligations, in this case the lack of proper signage and signs,” says Ernest.
