“Independent agency” obviously means different things to different people. But the SEC’s position is that the White House has a formal role in the SEC developing its CRD rule. Wut.
In addition, the GAO understands that SEC attorneys have stated in meetings and exchanges and even in status reports filed with the courts that their delay in handling the Energy Policy Advocates’ FOIAs is not a good thing. The amount is because they have to consult the White House on what they should offer. or keep.
So, last week the EPA filed another lawsuit advising the SEC’s correspondence with the White House on FOIA. Obviously another one to watch.
