An attorney representing RED TR-Racing, the company that owns the Kentucky Derby winner Presented by Woodford Reserve (G1) rich attack submitted a petition on December 2 to the Equestrian Integrity and Safety Authority asking the agency to review its decision not to find competitors in violation of regulations regarding wearing toe clips.
The violation of HISA rule 2276 is alleged to have occurred on October 1 Lukas Classic Stakes (G2) at Churchill Downs where Charlie’s Hot Stick beat Rich Strike by head. On October 18, HISA published an investigation into the race that concluded that intern Doug O’Neill was not in violation.
Lexington-based attorney Barry Hunter filed the claim.
In the application, Hunter wrote that RED TR-Racing “has not yet been given a chance to test the shoes it is alleged to have worn” by Hot Rod Charlie in Lukas Classic. He writes that those shoes are in HISA custody.
He added that RED TR-Racing “didn’t have a chance to confront the testimony that the far carrier (Hot Rod Charlie’s) gave” to the Kentucky Horse Racing Commission managers “about the state of affairs.” of shoes.

As part of this motion, Hunter included enhanced shots that allegedly show Hot Rod Charlie wearing toe clips. Hunter also brought in another Lexington attorney, Frank Becker, who has photography experience.
Becker examined 50 different photos of the race taken by four different photographers in the Lukas Classic. Becker identified in his assessment that Hot Rod Charlie was toe-wearing.
Hunter wrote if HISA “believes that photographic evidence is not conclusive in this regard,” RED TR-Racing “requests permission to submit additional evidence, as well as testimony at the hearing at which ( it) can confront further testimony.”
