Justice Department appeals recent mask ruling: NPR

Don’t throw those masks away.
The US Justice Department said it was appealing a ruling by a federal judge that rescinded the mask-wearing requirement for public transportation.
DOJ spokesman Anthony Coley speak An appeal notice was filed following the Centers for Disease Control and Prevention’s decision that wearing a mask “remains necessary to protect public health.”
CDC says they have request DOJ to appeal. The public health authority continues to recommend that people wear masks in all indoor public transport, and says “wearing a mask is most beneficial in crowded or poorly ventilated places, such as traffic corridors.”
The Biden administration had previously hinted that it can appeal Judgment by US District Judge Kathryn Kimball Mizelle after checking with the CDC.
The department’s decision to appeal comes just two days after Mizelle ruled that the CDC had exceeded its authority and failed to follow proper rule-making procedures.
Following the judge’s ruling on Monday, many airlines waive their request For passengers to wear masks when traveling.
