Brooks was also charged with jumping on bail, as he was released on bail following the July 24 incident, according to court documents.
In a statement, the Milwaukee County District Attorney’s office now said it should not have offered Brooks such a low bail and has conducted an internal review of the decision.
The State’s bail offer in this case is disproportionately low given the nature of the recent and pending charges against Mr Brooks, the office said. “The bail recommendation in this case is not consistent with the Milwaukee County District Attorney’s Office’s approach to matters related to violent crime, nor is it consistent with the defendant’s prior risk assessment. on bail.”
CNN has reached out to Brooks’ attorneys regarding the 2020 incident and the November 2021 incident regarding the district attorney’s office statement but has not received a response.
In the first case of 2020, Brooks was charged with: two counts of reckless endangerment of the second degree, use of a dangerous weapon; and one count of possession of a firearm due to a felony.
The lawsuit alleges that Brooks fired a shotgun during an argument. Authorities said they found a stolen handgun during Brooks’ arrest and three “multicolored pills,” which later tested “presumptively positive” for methamphetamines.
The bail was originally set at $10,000 in that case but because Brooks requested an expedited jury trial, which could not be met, the bail was reduced. 500 dollars left. Brooks was released on bail in that case on February 21, according to the district attorney’s office.
