Jury’s ‘political leaning’ reminder was erroneous in ‘Build the wall’ case
On Thursday morning, 11 jurors submitted their notes, which quoted the group of 12 making remarks that included: “Tim Shea is a good man. He doesn’t hit his wife” and “You just can’t vote to love someone”.
Goes on to say that the jury showed hatred for the government, alleging that Mr. Shea was tried in the Southern District of New York because the people there voted a certain way but instead he We should be tried in a Southern state. That jury also included topics of discussion outside the scope of the trial, including talk about “political parties,” according to the note.
Citing a “breach of oath,” the note asked Judge Torres to replace the juror with a replacement.
Judge Torres questioned that juror away from panelists and the public. According to a transcript, she asked if the juror had a “personal bias or opinion” that prevented him from being “fair and objective,” and if he could determine the facts in his words. her interpretation of the law and whether he could consult other jurors. The jury answered no to the first question and yes to the second two.
Immediately after, the judge instructed the jurors to continue deliberation.
The jurors wrote to the judge on Tuesday saying they had reviewed the evidence in “concrete” detail, but could not agree on a verdict on any of the charges.
After the trial, the jury’s director, Richard Nardini, said 10 members were convinced of Mr. Shea’s guilt. Mr. Nardini added that one side has not made a decision, and the 12th party asserted that prosecutors failed to prove their case, and raised topics unrelated to the evidence. Some of the same jurors said.
Another juror, Racquel Henry, said the 12th juror suggested that Mr. Trump provided money for the wall fund. A third, Lauren Reyes, said trying to communicate with the man was “incredibly frustrating”, adding: “It’s like talking to a wall.”
The 12th juror, who declined to give his name, said he harbored reasonable doubts and would not say whether he slept.
