Harvey Weinstein was hospitalized upon returning to New York after an appeals court invalidated his 2020 rape conviction.
According to the Associated Press, Weinstein was transferred from the city jail to Bellevue Hospital in Manhattan.
Harvey’s health problems
Weinstein’s lawyer, Arthur Aidala, said the former movie mogul is suffering from many medical complications. He said he needs special care to stay in good health.
“It seems like he needs a lot of help physically. He’s having a lot of problems.” Aidala said.
He continued, “He’s getting all kinds of tests. Health-wise, he was like a train wreck.”
The Miramax co-founder is said to suffer from several diseases including diabetes and sleep apnea. Additionally, he has eye problems.
Although the 72-year-old is said to be in physical decline, Aidala said he is mentally stable. Furthermore, Harvey’s legal representatives said he remains grounded. He claims Weinstein is “sharp as nails” and added that his “Feet firmly planted on the ground.”
Weinstein’s attorney said Bellevue doctors must perform several tests before he can be transferred to the Riker’s Island jail complex. According to New York City Department of Corrections spokesman Frank Dwyer, the former filmmaker remains incarcerated at Bellevue. Although his 2020 conviction was overturned, he will not be released because he was convicted in LA for another case. In 2022, Mr. Weinstein pleaded guilty to rape and was sentenced to 16 years in prison.
What will happen next in court?
However, vacating Harvey’s sentence means the 23 years in prison he faced are erased. Furthermore, a retrial was ordered. Prosecutors are seeking to retry him on charges of orally raping a film and television production assistant in 2006. Additionally, they plan to retry the disgraced producer for rape an aspiring actor in 2013.
Furthermore, Aidala plans to inform the judge when Weinstein appears in court on Wednesday that the retrial will take place after Labor Day.
Thomas Mailey, a spokesman for the state Department of Corrections and Community Supervision, confirmed that Weinstein had been turned over to the city’s Department of Corrections. Previously, Weinstein was detained at Mohawk Correctional Facility, about 160 km northwest of Albany.
