Tesla sued by family of motorcyclist killed in Autopilot crash



SAN FRANCISCO — The parents of a motorcyclist killed in a 2022 crash involving a Tesla Model 3 on Autopilot in Utah has sued the electric car maker and the vehicle’s driver, claiming that its driver-assistance software and other safety features are “faulty and inadequate.”

Landon Embry, 34, died at the scene following the incident. Model 3 on autopilot at 75-80 miles per hour crashed into the back of his Harley Davidson motorbikethrew him off his bike, according to a lawsuit filed in state court in Salt Lake City last week.

The lawsuit claims the Model 3 driver was “fatigued” and “not qualified to operate the vehicle as an ordinary prudent driver.”

The complaint says the autonomous driving system’s sensors, such as cameras, “must be able to determine when present that the victim’s motorcycle is in danger.”

“A reasonably cautious driver or a fully autonomous vehicle brake systemcould have slowed or stopped without colliding with the motorcycle,” the complaint said.

Tesla could not immediately be reached for comment.

The lawsuit adds to growing scrutiny of Tesla’s Autopilot and Full Self-Driving driver assistance systems.
