An Alabama judge granted a former Alabama The basketball player charged with murder a hearing to decide whether the charges in the case should be dismissed.
lawyer for Darius Miles on Wednesday filed a motion for immunity, asking Judge Daniel Pruet of Tuscaloosa County to dismiss the murder charge on grounds of self-defense, news agencies reported. Miles is charged in the fatal shooting of Jamea Jonae Harris, 23, in Birmingham, on January 15.
Miles “respectfully asks the Court, after hearing the evidence, to declare (he) not indicted” and the case against him is dismissed, according to records from his attorney, Mary Turner, on Wednesday.
Pruet accepted Miles’ request for a waiver hearing, set for August 21.
Miles, 21, and Michael Davis were both charged in connection with Harris’ death.
Davis, 20 years old, searched juvenile delinquency and since then court records for Davis have been sealed. The outcome of that request was still unclear as of Friday morning, al.com report.
Pruet rejected the bond for Miles in May, saying the matter would be reviewed at a later date.
The shooting happened on the Strip, a student business district of bars and restaurants near the Tuscaloosa campus. Investigators said Harris was in the passenger seat of a car when she was hit by a bullet, which led to her being charged with murder in Alabama.
Davis is charged with shooting and killing the young woman, according to court documents filed in Tuscaloosa. Investigators wrote in a court document that Miles admitted to providing the handgun shortly before the shooting.
Defense attorneys had suggested in an earlier trial that the two were reacting in self-defence after an argument with a young man in Harris’s group.
Miles was fired from the Alabama team after his arrest.
