A movement sought to suppress wiretap proof within the federal authorities’s case towards coach Jason Servis and others for utilizing and distributing mislabeled and adulterated medication in racehorses was denied by U.S. District Decide Mary Kay Vyskocil.

The order filed by Vyskocil Nov. 4 also includes a proposed trial schedule for defendants maintaining their innocence, including Servis.
The first group includes veterinarian Seth Fishman and distributor Lisa Gianelli, and the second group includes trainer Rick Dane Jr. and distributor Rebecca Linke. Federal prosecutors will confer with the legal counsel of Servis and defendants Erica Garcia, Michael Tannuzzo, and veterinarian Alexander Chan about trying all four together in a third trial group.
Vyskocil has requested the first trial be held on or around Jan. 19.
