Brianna and Savannah, Two sisters from Texas, overjoyed to finally be reunited with their beloved Byron, Maltipoo. After he mysteriously disappeared from their yard on New Year’s Eve 2020, they were devastated. Not only were they involved in bottle feeding him after their pooch had puppies, but he was also welcomed into their family as Brianna’s emotional support dog. The pair did everything they could think of to try to bring him home.
They immediately noted him as missing on their microchip app, Nextdoor and Ring. They are constantly checking their local animal control and posting all over social media. Plus, they post flyers and search multiple times throughout their entire neighborhood. They did hundreds of hours of work. However, there was still no sign of Byron.
However, they never gave up hope. They know Byron has microchips and their information is up to date. Brianna even kept his chip information in her wallet, just in case. She continues to check their accounts weekly. Because he was chipped, The two of them continued to harbor hope that one day, they would receive a call that Byron had been found.
But after a year, their trust started to decline and they checked their accounts less and less. It was only because Brianna had a dream about them being reunited with Byron that she was inspired to double-check their accounts.
“We happened to check our chip account a year and a half later only to discover that Byron was no longer in our account. So we reached out to the microchip company to try to figure out anything we could, and they let us know that Poodle Rescue of Houston has moved it to another family. They never contacted us and never contacted us to let us know.”
When Brianna and Savannah When they discovered that Byron had not only been found but had also been taken away without their knowledge, they were shocked and outraged. Surname right away began investigating his microchip profile. From there, they were able to connect Byron’s microchip to a dog that was renamed and adopted in February 2020. They found Byron! With all that information, they contacted The Poodle Rescue in Houston.
“Basically, the Houston Poodle Rescue team said the new owner doesn’t want to return it, we’re not going to continue this conversation. They tried to make a deal with us so we would let the situation unfold, but we wouldn’t accept it. We want Byron to come home,” Savannah said.
Not only did the rescue tell them they wouldn’t discuss Byron anymore, but it also tried to convince them to adopt another dog. As you might have guessed, the sisters declined, as they were only interested in their dear family member.
Determined to bring Byron home, the sisters created a Facebook page, and GoFundMe account, in hopes of spreading their story and raising the money they need to get legal advice. Their story went viral and they received a lot of support online. It was through their internet presence that they connected with their incredible team of lawyers who eventually made it possible for them to reunite.
“They started the legal proceedings, pushed Houston’s Poodle Rescue to settle it, and brought Byron home with us,” Savannah said.
Savannah and Brianna were able to uncover many things on their own, but once their attorneys were involved, they were able to dig even deeper. What happened is the uploaded the chip series of Poodle Rescue of Houston without their consent. Then, in an email, the chip company shared that when there is a transfer based on a partner’s upload, it does not need to notify the previously registered owner because registration of the chip is not proof. on ownership.
Their lawyers also discovered that the microchip company’s fine print allowed them to argue that what they did in this situation was perfectly legal. However, Brianna and Savannah are still bringing lawsuits against the company.
“The Houston Poodle Rescue Team and the microchip company both knew that we were the rightful owners of Byron and decided not to notify us or contact us in any way,” said Savannah.
