UN expert urges UK to stop sending asylum seekers to Rwanda |

“There are serious risks that the principle of international law of non-refundable will be violated by forcing the transfer of asylum seekers to Rwanda,” said Siobhán Mullally, United Nations. Special Rapporteur on Human Traffickingespecially women and children.

“Those who seek international protection, fleeing conflict and persecution, have the right to seek and enjoy the right to asylum – a Fundamentals of human rights and international refugee law,” she speaks.

The Special Rapporteur welcomes the urgent interim measures taken by the European Court of Human Rights, which made a flight earlier this week, due to the transfer of a small group of asylum seekers to the Central African country.

Increased mining risk

Transferring asylum seekers to third countries does nothing to prevent or combat human trafficking, in fact it has the potential to push desperate people into more dangerous and difficult situations,” Ms. Mullally said. “Rather than reducing human trafficking, it has the potential to increase the risk of exploitation.”

The Special Rapporteur expressed concern that this agreement does not protect the rights of asylum seekers who are victims of human trafficking and are seeking protection in the UK. These victims and people at risk of trafficking can be transferred under the agreement, she said.

‘Inadequate safeguards’

“There are insufficient safeguards in place to ensure that victims of human trafficking or those at risk of being trafficked are identified, supported, and guaranteed effective access to international protection. They risk becoming victimized and further traumatized by being transferred to a third country,” added the Special Rapporteur.

“I am also concerned that there are not enough guarantees against the risks of trafficking or re-trafficking for people who may be denied asylum or voluntarily move to another state from Rwanda.”

Miss Mullally repeated concerns of the United Nations High Commissioner for Refugees on difficulties that arise when disclosing traumatic experiences – such as human trafficking – in screening interviews of asylum seekers, usually conducted shortly after arrival.

Under the agreement, UK authorities will conduct an initial screening before deciding if an individual can be transferred.

Independent expert said Initial screening is not sufficient to identify and recognize specific protection needs of asylum seekers, including victims of human trafficking.

Previous concerns about human rights

The Special Rapporteur has before raise her concerns related to the Nationality and Borders Bill, and its potential negative impact on the human rights of victims of trafficking.

She has also repeatedly raised concerns with the international community about the increasing tendency to place the issue of migration in the criminal law enforcement model.

“Restrictive measures related to migration are introduced as part of efforts to combat organized crime, including human trafficking, regardless of how such measures may affect human rights. people of migrants and traffickers,” said the UN expert.

Make it safer to move

She called on States to open up safe, orderly and regular migration routes, without discrimination, to combat human trafficking.

Resettlement programs, family reunification measures and humanitarian visa provision are more effective ways The Special Rapporteur said to prevent the trafficking of people fleeing persecution and conflict.

She called on all States to uphold their international obligations of the principle of non-refit in international law, which ensures that no person is returned to a country where they can face irreparable harm.

We must not allow anti-trafficking goals to be misused, aimed at undermining the right to seek and enjoy asylum in the wake of persecution.and the principle of not retooling,” she concluded.

The Special Rapporteur reports to Dong Nhan Quyen Association and operate in their personal capacity. They are not employees of the United Nations and are not paid for their work.
