The The Supreme Court has overturned the constitutional right to abortion in the US.
The court decision issued yesterday is the culmination of a generational conservative campaign to bring down Roe v. Wade, the 1973 Supreme Court ruling establishing abortion rights. The three conservative judges that Donald Trump appointed to the court that provided the votes ultimately did so.
“The Constitution makes no mention of abortion, and no such right is expressly protected by any constitutional provision,” Justice Samuel Alito wrote to the majority.
Roe’s downfall was a political and social earthquake, an earthquake that Americans alternated honor and mourn. “I can’t think of a precedent for this in our modern history where you have the individual civil rights people depend on that are set back 50 years,” my colleague Emily Bazelon , the abortion rights writer and the court said.
Yesterday’s ruling won’t end the abortion debate, but it will fundamentally change it. Today’s newsletter explains what this decision means and what could happen afterward.
Immediate impact
The ruling quickly moved the political battle against abortion to the state level. That is, Alito writes, one of the purposes of the court: “The power to regulate abortion must be returned to the people and their elected representatives.” (This is an annotated version of the rulinglargely followed the draft leaked to Politico last month.)
Roe’s fall immediately caused abortion bans in Kentucky, Louisiana and South Dakota. Missouri, Arkansas and other states did the same within hours. In total, more than 20 states appear to be outlawing all or nearly all abortions. (This tracker shows access to abortion in all 50 states.)
For about half of Americans living in those states, abortion will become even more difficult. For women in Mississippi, for example, Illinois might become the closest state to getting one legally.
More liberal states began to move in the opposite direction. In Massachusetts, Governor Charlie Baker, a moderate Republican, signed an executive order protecting medical providers from performing abortions on foreign residents. The Democratic governors of California, Oregon and Washington issued a joint statement promising to protect access to abortion and contraception.
The ruling may have less effect on overall abortion rates. Some experts estimate that overturning Roe could reduce the number of legal abortions in the US by 13%. That’s because abortion has been heavily restricted in the red states, and more and more people living there oppose it, like The Times’ Claire Cain Miller and Margot Sanger-Katz. explained.
But Roe’s fall will likely reduce access to abortion the most for lower-income women and black and Hispanic womenmany of them lack the resources to go out of state to get one.

The ruling is also likely to take the abortion debate into new territory. “There are all these similar divisions, to which we don’t know the answers yet,” says Emily.
One is the drug abortion pill question. About half of all abortions are legal in the US happen with drugs, is generally safe and effective, rather than a surgical procedure. Texas and Louisiana have made it a crime to mail drugs in the states, and other states could follow suit. “So the question is what penalties are they imposing, and how will they enforce that law?” Emily said. “Do they want to open people’s mail and start surveying people?”
States that ban abortion could also seek to penalize healthcare providers in other states who perform abortions on women living in states where abortion is illegal or instruct patients to remotely about how to get or take the abortion pill. President Biden said his administration would act to protect access to FDA-regulated pills, and to protect women who want to travel for abortions.
Decision can also reverberate to other similar privacy-based precedents that underpin Roe. Although Alito warned that the ruling should not be seen as going beyond abortion, a justice in the majority – Clarence Thomas – wrote separately that the court protective measures should also be reversed on access to contraception, same-sex relationships and same-sex marriage.
Emily said: “We don’t know how many votes there are for that. “Thomas is the only one willing to say it today, but that doesn’t mean there weren’t five votes.”
