Texas Attorney General Sues To Stop Biden Administration

The state of Texas is taking further action regarding abortion. According to CNBC News, the state has asked a federal court to block the Biden administration’s request that doctors and hospitals provide abortion services during medical emergencies. Reports show that in a lawsuit filed in the Northern District Court of Texas, Attorney General Ken Paxton argued that federal law does not grant abortion rights.

The lawsuit comes days after Health and Human Services (HHS) Secretary Xavier Becerra wrote a letter to healthcare providers on Monday. In the letter, he explained that Physicians are required to provide abortions during a medical emergency under federal law and will face penalties if they refuse to provide the procedure in these circumstances.

Xavier warns hospitals and doctors that they must provide abortion services in the event of an emergency that requires treatment to save a pregnant woman’s life. Some of these medical emergencies include, but are not limited to; ectopic pregnancy, complications from miscarriage, and hypertensive disorders such as preeclampsia. If you’re not familiar, preeclampsia leads to high blood pressure, severe headaches, and blurred vision. If left untreated, this can lead to fatal complications.

However, Attorney General Paxton said the law did not mandate any specific remedies. He argued that HHS’s request was illegal, unconstitutional and unenforceable. In a press release from his office, he said, “With this move, the Biden Administration seeks to turn every emergency room in the country into a door-to-door abortion clinic.”

The release continued, “EMTALA does not authorize and has never been presumed to authorize the federal government to require emergency health care providers to perform abortions.” President Biden is doing his best to protect women. He recently issued an executive order directing HHS to take action to protect access to abortion.

Currently, at least nine states have banned abortion because of a Supreme Court ruling that overturned Roe v. Wade. Several other states have tried to ban the procedure, but their laws have been blocked by state courts.
