Man accused of beating Giuliani must pay less after video surfaced

A grocery store employee who allegedly assaulted Rudolph W. Giuliani at a Staten Island supermarket on Sunday has been charged with a reduced charge against him after a video emerged showing him patting him on the back. Giuliani with an open palm rather than hitting him. .

The worker, Daniel Gill, was charged with second-degree assault, a felony, shortly after the episode. Prosecutors later reduced the charges to third-degree assault, misdemeanor, third-degree intimidation and second-degree harassment.

After a day in custody, Mr Gill, 39, was charged with a lesser charge in Staten Island Criminal Court on Monday. He was released by Judge Gerianne Abriano and ordered to return to court in August.

The encounter happened around 3:30 p.m. when Mr. Giuliani was at the store, on Veterans Road West in the Charleston neighborhood, to advocate for my sonAndrew Giuliani, a Republican candidate for governor, according to officials.

In their initial account of what happened, police said Gill, a Staten Island resident who works at the store, slapped Giuliani, the former mayor of New York City, on the back while said, “What’s the matter, scum?”

The complaint alleges Mr Gill said he hit Mr Giuliani so hard that the blow caused “significant pain in the back and left side of his body” and caused Mr Giuliani to stumble forward.

But the footage of the episode, taken and published by The New York Post, which appears to show Mr. Gill touching, rather than hitting, Mr. Giuliani on his back near his left shoulder as he passed him. The video without sound also shows Mr Giuliani leaning slightly forward after Mr Gill touched his back.

It was not clear on Monday what prompted Mr Gill’s actions and could not be reached for comment.

Mr. Giuliani stated in a Online press conference on Monday that the case is related to the Supreme Court’s overturning of Roe v. Wade last week. (He said on Sunday that Mr. Gill had told him, “You’re going to kill women.”)

Mr. Giuliani, 78, angered during the press conference about the allegation, saying, “What the hell is this DA doing to get him out of jail.” He claimed the video footage was “deceptive because it only shows the hand on my back.”

“I did not fall,” Mr. Giuliani said. “I might have. If I fall, who knows.”

“This little punk won’t hurt me,” he added. “The Mafia has threatened to kill me twice.”

The Legal Aid Association, which represents Gill, said in a statement on Monday that the charges against him were “inconsistent with applicable law.”

“Our client just patted Mr. Giuliani, who from a distance suffered nothing resembling physical trauma, with no malice simply to get his attention, as the video footage clearly shows. clear,” the statement continued.
