Her four children have filed a lawsuit against Turbo Restaurants LLC, the company that owns the franchise in question.

The family argued that Le’s death could have easily been prevented.

According to the report, the lawsuit specifically refers to the freezer door, which is likely to have broken latches.

Family is seeking $1 million in damages, according to fox 34. They are also asking for a walk-in freezer inspection and a jury trial.

A spokesperson for Arby shared a statement with CBS News about the incident. However, the company added that it could not comment further pending the investigation.

“We are aware of the tragic incident that occurred at our franchised location in New Iberia, LA. Franchisees fully cooperate with local authorities when they conduct investigations. As this is an active investigation, we are postponing any further comment to the state police department.”

Furthermore, Turbo Restaurant has not made a public statement about the incident.
