Keeping the release order on Steam in HISA-Jockeys ‘Guild Uproar


On the evening of August 3, the 5th Circuit Court of Appeals granted administrative clearance for the enforcement of a preliminary order against the Horseracing Integrity and Safety Authority last weekend.

The original order was issued July 26 against HISA, the Federal Trade Commission and others of the U.S. District Court for the Western District of Louisiana. The plaintiffs in the case are essentially the states of Louisiana and West Virginia, the Jockeys’ Guild, and several individuals.

Entry means that, at present, the order has no effect or effect in any racing jurisdiction.

Time in the Fifth Round will reduce from a simmering dispute to a heated one as the preliminary order means. On its own terms, the geographic scope of the order is limited to the states of Louisiana and West Virginia, “and to all plaintiffs in this proceeding.”

After HISA continued to enforce its rules against members of the Jockeys’ Guild riding outside the geographic boundaries of the ban, the plaintiffs called for fouls, arguing that the swindlers were deemed to be bluffs. plaintiff in the proceedings and filed a petition for contempt of court and a request to enforce the order. Those matters are currently on hold pending the next Fifth Street ruling.

The length of administrative stay is not determined. It is not a stay based on the merits of the case; instead, the stay is temporary pending further review of the stay motion. An appeal to the preliminary order filed by HISA and others is also pending in the Fifth Circuit Court of Appeals.
