Industry appeals Gulf of Mexico court ruling, warns of significant consequences for US energy security

WASHINGTONSeptember 12, 2024 — The American Petroleum Institute (API), EnerGeo Alliance, National Ocean Industries Association (NOIA), and Chevron USA Inc. today issued the following joint statement following file an appeal The U.S. District Court for the District of Maryland has decided to vacate the National Marine Fisheries Service (NMFS) Biological Opinion in the Gulf of Mexico. “U.S. oil and natural gas production in the Gulf of Mexico is a driver of energy security in the United States and around the world, supporting hundreds of thousands of jobs and generating billions of dollars in state and local revenues. If this ruling is not challenged, a critical source of current and future U.S. energy supplies could be threatened at a time of persistent inflation and geopolitical uncertainty. We intend to pursue all legal remedies to prevent the far-reaching consequences of this ruling for the Gulf Coast economy and American families who depend on access to reliable, affordable energy.”

By rescinding the biological opinion without giving NMFS sufficient time to issue a revised opinion, this court’s decision threatens to significantly slow or halt all permitting for routine, routine operations. This puts current and future energy production at risk and undermines efforts to protect the environment and worker safety.

This ruling could lead to a rapid shutdown of all oil and gas production in the Gulf of Mexico. The lack of a biological opinion from NMFS means that BSEE (Bureau of Safety and Environmental Enforcement) will have to consult with NMFS on all permit requests for any activity in the Gulf of Mexico.

Judge Biden’s patently arbitrary, capricious, and malicious ruling cannot be construed as anything other than a treasonous attempt to undermine America’s energy security. It would quickly remove 1.8 million barrels of crude oil per day from our energy supply. The devastating consequences would be global.

As if this wasn’t treacherous enough…

They will shut down 1.8 million barrels per day of production after destroying the Strategic Petroleum Reserve…

The oil and gas industry would almost certainly prevail in this scenario, but there is a good chance of significant production disruptions this winter.

While the mainstream media constantly tries to Biden credit about record US oil production, the fact that his mismanagement has routinely broken the law in their treasonous war on the US oil and gas industry…
