American Airlines is settling a class-action lawsuit for $7.5 million for unfairly charging passengers for checked baggage they shouldn’t have paid in the first place.

Settlement related to charges administered by Americans from 2013 to 2021, according to Business Insider. The plaintiffs – five customers – argued that the airline had refused to waive those fees for some credit card holders and priority passengers, as promised. If the Americans have not settled last Friday, the case will go to trial in Texas in two weeks.

The company declined to comment on the deal Business Insider, although the newspaper cited court documents in which American agreed to fully compensate all class members who filed lawsuits in a timely manner and there was no ceiling on the settlement. In other words, the airline could rake in more than $7.5 million when all of this is said and done, depending on how many customers apply. In each case, when the plaintiffs later tried to check their bags at the airport, they were told they would have to pay at the desk. The Americans countered that petition by denying all charges, although admission fees were paid in certain cases.

The settlement is currently undergoing preliminary court approval. If granted, American Airlines will contact relevant customers by mail and/or email.
