Alec Baldwin’s attorneys said Thursday that New Mexican authorities destroyed the gun that killed cinematographer Halyna Hutchins on the set of “Rust.”

Alex Spiro, one of Baldwin’s attorneys, said: “The court, I don’t think I know of this point, but I think I should tell the court that the gun in this case… was destroyed by the state. “. fifth hearing. “That’s clearly a problem and we’ll need to see that gun, or what’s left of it.”

Prosecutors did not respond to Spiro’s assertion during the hearing. They did not immediately respond to CNBC’s request for comment.

Baldwin, star and producer of “Rust,” was holding the gun when it killed Hutchins. He has denied that he pulled the trigger.

Baldwin’s attorney and the film’s original weapons builder, Hannah Gutierrez-Reed, mostly appeared at Thursday’s hearing. The defendants are accusation two different types of involuntary manslaughter following the shooting death of cinematographer Halyna Hutchins in October 2021. Both charges carry a possible maximum sentence of 18 months in prison. The jury will decide which of the two counts, if any, to convict.

prosecute mes was facing pressure for some of the mistakes it has made since opening the criminal case just over a month ago. For example, an 18-month prison sentence might be a lower penalty than the original punishment Baldwin and Gutierrez-Reed were up against.

Special Prosecutor Andrea Reeb initially charged Baldwin with firearms enhancements, which would cost him an additional five years in prison if convicted. Reeb acknowledge in email with Baldwin’s attorney that she misapplied that enhancement, which had no effect at the time of the shooting.

Baldwin’s attorneys filed February 7 for Reeb to withdraw from the case, but she refused on Monday.

Reeb concurrently served as special counsel in the “Rust” case while serving as the Republican state legislator. New Mexico the constitution forbids a member of one branch of government exercises the power of another branch.

DA’s office stated in court filings on Monday that because special prosecutors are “not a perfect fit” in both the executive and judicial branches, the “reasonable conclusion” is that special prosecutors do not belong to either branch. In the February petition, Baldwin’s attorneys argued to the contrary that the power to prosecute cannot be neatly classified as executive or judicial because it belongs to both branches.

A hearing on the disqualification petition will be scheduled for March 27.
